Maternity Leave, Child Care Leave: Sixth Pay Commission

Some more good news for the central government employees, especially the female employees. The Central Government has decided to increase the period of Maternity leave for women employees and also intriduce the concept of Child Care Leave. Though this recommendation by Sixth Central Pay Commission will be beneficial for female employees, it will equally be beneficial for male employees as the entire family life would benefit. Consequent upon the decisions taken by the Government on the recommendations of the Sixth Central Pay Commission relating to Maternity Leave and Child Care Leave, the President is pleased to decide that the existing provisions of the Central Civil Services (Leave) Rules, 1972 will be treated as modified as follows in respect of civilian employees of the Central Govemment:-Maternity Leave Child Care Leave Sixth Pay Commission

(a) The existing ceiling of 135 days Maternity Leave provided in Rule 43(1) of Central Civil Services (Leave) Rules, 1972 shall be enhanced to 180 days.

(b) Leave of the kind due and admissible (including commuted leave for a period not exceeding 60 days and leave not due) that can be granted in continuation with Maternity Leave provided in Rule 43(4)(b) shall be increased to 2 years.

(c) Women employees having minor children may be granted Child Care Leave by an authority competent to grant leave, for a maximum period of two years (i.e. 730 days) during their entire service for taking care of upto two children whether for rearing or to look after any of their needs like examination, sickness etc. Child Care Leave shall not be admissible if the child is eighteen years of age or older. During the period of such leave, the women employees shall be paid leave salary equal to the pay drawn immediately before proceeding on leave. It may be availed of in more than one spell. Child Care Leave shall not be debited against the leave account. Child Care Leave may also be allowed for the third year as leave not due (without production of medical certificate). It may be combined with leave of the kind due and admissible.

2. These orders shall take effect from 1st September, 2008.

3. In view of paragraph 2 above, a women employee in whose case the period of 135 days of maternity leave has not expired on the said date shall also be entitled to the maternity leave of 180 days.

4. Formal amendments to the Central Civil Services (Leave) Rules, 1972 are being issued separately.

5. In so -far as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are issue in consultation with the Comptroller & Auditor General of India.

Hello,
I am a central railway employee and was on maternity leave from 25th feb 2007. after completion of 135 days ML and extended child care leave of One year, I still require more leave as my child needs more attention. When the proposal of 180 days ML was published, i was given clue that 6th pay commission is with effect from 1st Jan 2006. So i Think the benefit of ML also should be the given from the same date.
Am i entitle for the same as it also gives financial benefit as salary to the female staff.

flexi hours is more beneficial to the female employees and it will not affect the work also.People tend to finish the work to avail the benefit of flexi hour facility.It is also seeen that inspite of the 2 years leave ladies would like to t ake permission often for the childrensake.Hence fklexihours is more suitable.

i am a male railway employee(central government employee) having a only son of 12 years old, can i awail the childcare leave for 02 years as recommanded by sixth pay commision...and i am soon going to be a father of a baby, expected in december 2008.. can i awail childcare leave for the same..as per sixth pay commision..

I am female employee with private org. from last 3 years . I am expecting my delivery after 4 months. as per our company HR rules, i will be getting 45 days prior and 45 after delivery OR 90 days after delivery. Is i am eligible for 180 days leave?

child care leave 370 days in entire service period is allowed upto 2 childs but if a lady having 3 kids below 18 & would like to avail this leave only for 2 kid. whether this is allowable?
like in income tax rule exemption for education is allowable upto two childern

hello,
i am a central govt servant. afer the sixth pay commission issued order on child care leave i had applied for the above leave. while all others who had applied for child care leave, only myself was not granted stating no reasons thereof. though govt order is there, and also many other women have been granted ccl by their superiors, my application was rejected.

I am a DMRC employee. I gave birth to a baby on 14th may 2008. At that time i availed 135 days maternity leave. Now can i go on 2 years childcare leave.its my first child. During child care leave can i get my salary.

My wife working on Central Govt Education Society as PRT Teacher Pay role. She has 15 Earn Leave , We want to take the facility of Child Care Leave (CCL), becasue of my baby is 11 months old.Whether the Earn Leave affect to CCL grant or not.

my wife is working in south central railway, have a child on 13.11.09, she had applied for CCL and applied also. my baby is sick b'coz of summer(dehydration)and hospitalised.i've produced baby sick certificate also.she had no earn leave in her credit."BUT her APPLICATION WAS REGRETTED"without giving any reason.they are not even sanctioning her LWP.what we've to do?

hi i am a public teacher here in cebu province my appointment was august 19, 2008, i gave birth last april 4, 2009, i would like to ask if i can avail the double pay for maternity leave because i gave birth in vacation time, but my principal said that i cant avail the one month double pay because i did not reach yet 2 years in service...but others says that i stil can avail only one month not two months double pay pls help me kindly guide me what to do email me at babyherra@yahoo.com thank you God Bless Us

I have been selected through UPSC in Delhi Govt. Job class -1 Gazzeted officer, I gave my acceptence to join in the month of Jan 2010 till than I have been waiting for the appointment letter after enquiring I have come to know that it will take time 2 weeks more. I am in my family way and my delivery is due with in 3-4 days what will be the maternity rule applicable for me because I shall be joining the service few days after the delivery.

Can I avail Child Care Leave for my 2 minor children?
